South Korea prepares AI deepfake ban for 2026 local elections

SOUTH Korea will hold local elections on 3 June 2026, and for the first time will enforce two laws aimed at curbing the use of AI deepfakes in political campaigns.

Article 82-8 of the Public Official Election Act, established in 2023, prohibits generating deepfakes of sounds, images or videos that are hard to distinguish from reality for 90 days prior to election day, with violators punishable by imprisonment with labour for up to seven years or a fine between 10 million and 50 million won (roughly $6,700–$33,500 USD).

In addition, the AI Basic Act, put into effect this January, requires AI content to be clearly disclosed as AI-generated, including a potential administrative fine not exceeding 30 million won (about $20,000 USD) for non-compliance. To aid enforcement, the National Police Agency developed a deepfake detection tool in 2024, and observers note that regulation is a starting point rather than a complete solution, emphasising the need for rapid detection and platform accountability. Long-term, experts suggest a federal framework with labeling timelines and penalties would help guide forthcoming elections, including the 2026 midterms.
