OpenAI Faces DHS Request to Disclose User’s ChatGPT Prompts in Investigation

On October 23, 2025, it was reported that Homeland Security Investigations (HSI) requested user data from OpenAI related to a child exploitation investigation, marking the first instance of law enforcement seeking AI-generated chat logs as evidence. The investigation revealed that the suspect, Drew Hoehner, a 36-year-old military-connected individual, had been using ChatGPT to generate content, including a humorous poem.

Despite the request for data, investigators identified Hoehner through other means, including military records. The case highlights the growing trend of law enforcement using AI platforms as sources of evidence, raising concerns about data privacy and the responsibilities of AI companies in handling user data.
