SEC to Notify Crypto Businesses of Technical Violations Before Taking Action: Report

According to Financial Times, the SEC plans to issue crypto firms notices of technical violations before taking enforcement action, a move described as a shift away from the aggressive approach of the Biden era. The report notes that Trump-appointed SEC Chair Paul Atkins told the Financial Times in Paris that the agency would continue to pursue fraudsters but that there would be “other gradations” requiring notice.

Atkins criticised what he described as the SEC’s past habit of “bashing down doors” over minor violations, saying enforcement would now stop treating technical mistakes with the same harshness. He argued that regulated businesses should have a chance to correct compliance issues before action is taken. The remarks frame the plan as an effort to address concerns over due process, proper notice, and the rule of law in the commission’s work.
