Is Gmail’s Spam Filter Politically Biased? The FTC Investigates

The Federal Trade Commission has turned its scrutiny toward Google, asking whether Gmail’s email filtering harbours political bias, with FTC Chair Andrew Ferguson sending a letter to Alphabet CEO Sundar Pichai alleging that Republican-related emails may be flagged as spam more often than Democratic ones.

According to the Federal Trade Commission (FTC), Ferguson warned that if Gmail’s filtering prevents Americans from receiving messages they expect or hinders their ability to donate, it could fall under provisions of the FTC Act prohibiting unfair or deceptive practices. Google countered that Gmail’s spam filtering relies on objective signals rather than any political agenda, noting it would review the letter and engage constructively with regulators.

The piece also cites a New York Post report claiming Republican-aligned emails flagged to spam while Democratic fundraising messages faced fewer obstacles, a claim described as not yet resolved by other regulators or courts. The controversy echoes earlier disputes, including a 2023 FEC dismissal of similar complaints against Gmail and a rejected RNC lawsuit, underscoring ongoing concerns about the role of platforms in political discourse.
