“Pompompurin’s” re-sentencing is scheduled for Tuesday. What will the judge do this time?
According to DataBreaches[.]Net, “Pompompurin” (Conor Brian Fitzpatrick) is set for re-sentencing on 16 September before Judge Brinkema, the same judge who originally sentenced him. He was arrested in March 2023 and charged with three counts including conspiracy to commit access device fraud, solicitation for access devices, and possession of child pornography, to which he pleaded guilty.
The government is seeking a minimum prison term of 188 months, alongside restitution and 20 years of supervised release with special conditions, while noting the substantial harm his crimes caused and the risk of recidivism. The defence argues for a markedly lenient outcome, proposing 15 years of probation with weekend confinement and concurrent treatment-focused conditions, arguing his mental health needs and compliance on supervised release to date.
DataBreaches[.]Net notes that the court must balance deterrence, punishment and incapacitation, while considering the defence’s arguments and the government’s restitution demands, before delivering the sentence next week.
