Dutch Court Orders Meta to Fix Algorithmic Feed, Citing DSA Violation

According to Reuters report, a Dutch court has ruled that Meta must revise the design of Facebook and Instagram feeds, finding that the current algorithmic recommendations violate the Digital Services Act (DSA) and restrict users’ freedom to choose how information is presented.

The court noted that users in the Netherlands “are not sufficiently free and autonomous in deciding whether to use personalised recommendation systems” and ordered that feeds provide an option to view content in chronological order or through other non-algorithmic sorting methods. It also requires that once a user disables the algorithmic feed, the platforms may not automatically revert to it upon reopening the apps.

Meta said it would appeal, arguing that the interpretation and enforcement of the DSA should be handled by the European Commission and EU regulators rather than national courts. If Meta fails to comply within the mandated timeframe, it may face fines of $117,000 per day, potentially totalling up to $5.8 million. The ruling underlines the DSA’s enforcement power as it applies to major platforms and could prompt broader changes across the EU market.
